EA Asks to Dismiss Madden Monopoly Suit

Cost of Games Still Boosted at Retail

A couple months ago we had a story about a group of gamers suing EA Sports over the NFL license exclusivity deal present with the company’s Madden franchise.

GamePolitics has since learned that lawyers representing EA have filed a motion to dismiss the complaint from federal court on Monday.

Calling the case “fatally flawed” and claiming that “It is not illegal–under any theory–for EA to bid on exclusive licenses,” company attorneys made their case conveniently after the Federal Trade Commission OKed a potential acquisition of Take-Two Interactive by Electronic Arts.  The FTC investigation may have included monopoly implications should T2’s sports division fold into EA Sports if and when a buyout should occur.

Madden games remain $60 at retail cost for most systems.
