Blizzard Awarded Damages; Lawsuit Not Over
MDY and its founder Michael Donnelly have vowed not to close in light of a loss in court between them and Blizzard Entertainment over the MMOGlider program.
A court awarded Blizzard $6 million in damages after winning a copyright infringement claim. The company believed MMOGlider, a “bot” which allows World of Warcraft users to perform various tasks without being in front of the computer, had violated their rights.
It’s only estimated that MMOGlider generated under $3 million in revenue for MDY and Mr. Donnelly. By contrast, Blizzard had hoped to rake in triple the damages awarded.
The case isn’t over, however. In January, both sides will be back in court to settle outstanding legal issues, such as whether the Digital Millennium Copyright Act was broken, and whether Mr. Donnelly will have to pay the damages out of his own pocket.
Meanwhile, MMOGlider continues to be sold. Evidently, the court ruled against MDY in July, with damages only levied recently. MDY have gone on record via the MMOGlider message boards stating that the business will not be closing.
We’ll follow up in January as to the ultimate fate of MDY, Donnelly, and MMOGlider.
